CourtWrap: Delays, Violence, and a Failing System – Action Society Monitors Justice in the Western Cape

Courtrooms across the Western Cape continue to echo with the names of women and children brutalised, murdered, and forgotten by a justice system that moves at a glacial pace. From gang violence to intimate partner killings, these cases show the devastating cost of crime and state failure. Action Society remains present in these courts—not out of duty, but out of hope. Below is a breakdown of the latest developments in some of the region’s most harrowing cases.

ATHLONE MAGISTRATES COURT

Melany Stoffels: Killed in a supposed orchestrated ‘hit’

Last appearance: 2 June 2025

Next appearance: 11 July 2025

The court proceedings in the murder case of 26-year-old Melany Stoffels resumed in June. Stoffels was brutally killed with a hammer on 7 August 2024 in what appears to have been a planned ‘hit’ orchestrated by her former girlfriend in Heideveld. At the time of her death, she was pregnant. The man who carried out the attack surrendered to police on 11 August, and the ex-girlfriend was taken into custody later that same month. The case was postponed to 11 July for a regional court date.

BLUE DOWNS REGIONAL COURT

Poppy: Molested by creche driver

Last appearance: 4 June 2025

Next appearance: 1 August 2025

The case of Poppy, a four-year-old girl from Mfuleni in the Western Cape who was molested by an older creche transport driver in October 2024, continued in June. We are delighted that he was denied bail and will remain in custody for the time being. Following the events that led to Poppy’s attack, Action Society once again called for the National Registry for Sex Offenders to be made public. Privacy laws shouldn’t protect predators. The case was postponed to 1 August for legal representation.

On 22 March 2024, Angela Koopman was brutally attacked when her partner poured petrol over her and set her on fire. She was rushed to hospital in critical condition but later succumbed to the extensive burns she had suffered. The case has been postponed to 15 July for plea and trial.

MITCHELLS PLAIN REGIONAL COURT

Firdous Kleinschmidt: Killed in gang-related shooting

Last appearance: 9 June 2025

Next appearance: 20 June 2025

The murder trial of Firdous Kleinschmidt will continue on 20 June. Her death was tragic and underscores the reality that innocent children are often caught in the crossfires of gang violence. The Action Society team is hopeful that justice can be served during this trial.

KHAYELITSHA REGIONAL COURT

Thimna Kuze: Found dead after sleeping at a friend’s house

Last appearance: 11 June 2025

Next appearance: 27 June 2025

The murder case of Thimna Kuze was set to continue on 11 June, but postponed again due to repairs at this court and minor witnesses writing school exams. More than two years have passed since her murder. Thimna, a 13-year-old girl from Khayelitsha, was murdered on 25 March 2023, and her family is still waiting for justice. The young girl slept over at a friend’s house and was found dead a day later in a shack with blood in her nose, mouth and groin area. New equipment had to be installed at this court after it was burglarised, and the matter was postponed to 27 June as a result.

WYNBERG REGIONAL COURT

Melissa Dale: Raped and killed on a military base

Last appearance: 13 June 2025

Next appearance: 5 November 2025

Today marks two years since the brutal rape and murder of Melissa Bianca Dale, a disabled woman who was murdered on the grounds of the Wynberg Military base. The investigation has been completed but the trial is dragging along at a snail’s pace. The suspected murderer is the son of a South African Defence Force member living on the premises. The case was postponed to 5 November for the trial to continue.

CAPE TOWN REGIONAL COURT

Candice Robertson: Murder disguised as suicide

Last appearance: 29 May 2025

Next appearance: 17 July 2025

Candice Robertson, 38, was found dead on 30 April 2022 in a Green Point guesthouse – initially reported by her partner as a suicide, but later revealed to be a murder when forensic inconsistencies emerged. Action Society has consistently monitored the case and publicly condemned the slow pace of investigation, highlighting how her killer remained free while key evidence was delayed due to systemic failures. The accused appeared in court on 29 May 2025, and the matter has been scheduled for trial on 17 July 2025, with hopes that long-overdue accountability will finally follow.
