Action Society notes with serious concern that almost five weeks have passed since its Promotion of Access to Information Act (PAIA) application was submitted in October to obtain documentation relating to the unlawful release of convicted murderer Xolani du Preez. No response has yet been received from the Department of Correctional Services or any relevant authority. This lack of engagement raises serious questions about transparency and accountability within the correctional system.
While Action Society awaits a response, another serious failure has unfolded at Wynberg Magistrates Court. According to media reports, six detainees escaped from the court’s holding cells in late October. This incident highlights the same breakdown in custodial procedures that allowed Du Preez to be improperly treated as a remand detainee and wrongfully released, despite a valid High Court order directing his continued incarceration.
On 18 November 2025 Du Preez appeared in court again. The matter was postponed to 29 January 2026 for the completion of an outstanding probation report.
Action Society views the Wynberg escape as further evidence of widespread operational failures in the court and corrections environment. The absence of a PAIA response also suggests a reluctance by authorities to provide clarity on how these failures occur, who is responsible and what corrective action is underway.
“This is not an isolated incident. It is a clear indication of a system that is not functioning as it should. When convicted offenders are wrongfully released and detainees can escape from court cells, the public cannot trust that the justice system is working in their interest. Action Society will continue to push for full transparency. We will not allow this matter to disappear and we expect every relevant record and explanation to be provided,” said Action Society spokesperson Juanita du Preez.
Action Society remains ready to take further legal action should the Department of Correctional Services fail to comply with the PAIA request.
